It points to public resources and offices that may hold those materials. To confirm custody or obtain a record, use the relevant record custodian, such as WVDCR for regional-jail records, the Mercer County Sheriff's Department or municipal police for arresting-agency records, or the proper court clerk for court documents.
West Virginia FOIA, including WV Code 29B-1-3, may provide a request path for public records held by a custodian, but it does not override sealed, expunged, juvenile, medical, protected, active-investigation, security-sensitive, or otherwise exempt records.
